The Terms of Use constitutes a contract between us. The Terms include the provisions set forth in this document, in the MyFanFaves Privacy Policy, specific Contest Rules and other terms or conditions that may be presented to you from time to time in connection with specific Service offerings (all of which we collectively refer to as the “Terms of Use†or “Termsâ€). If you do not agree to these Terms, you do not have the right to access or use our Service. If you do use our Service, your use shall be deemed to confirm your acceptance of the Terms and your agreement to be a party to this binding contract.
By using the Service, you acknowledge, accept and agree with all provisions of the Privacy Policy, including, without limitation, our practices concerning data that you provide or that we may collect about you through the Services, and your consent to our use of data in compliance with the Privacy Policy.. Membership Eligibility

You may not use the MyFanFaves Service for any illegal or unauthorized purpose, including but not limited to gambling and violation of copyright laws. Compliance with Laws and Law Enforcement. PDMGolf may disclose any of your information if we believe that is reasonably necessary to comply with a law, regulation or legal request, to protect the safety of any person, to address fraud, security or technical issues.

Membership Account Termination
Please go to the Manage My Account page and use the link at the bottom left to access the Account Termination page. You have two termination options for your Membership. You can permanently remove your account and all associated data or temporarily deactivate your account. Deactivation simply makes your account inactive, but retains all your data. Simply log in to reactivate your account.

PDMGolf may suspend access to your account, or terminate your account, with or without notice according to these Terms. Reasons for MyFanFaves suspending or terminating your account may include, without limitation: (i) breach or violation of these Terms or any Separate Agreement; (ii) an extended period of inactivity (determined in MyFanFaves’ sole discretion) or (iii) unexpected technical or security issues or problems. MyFanFaves’ promise to protect your privacy will continue, even after your death or incapacity.

No Warranty
YOUR USE OF THE MYFANFAVES WEBSITE IS AT YOUR SOLE RISK. ALL MATERIALS, INFORMATION, SOFTWARE, PRODUCTS AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE WEBSITE (“MATERIALSâ€) ARE PROVIDED “AS IS†AND “AS AVAILABLE†FOR YOUR USE. THE MATERIALS ARE PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM MYFANFAVES THROUGH OR FROM THE WEBSITE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TERMS.

Limitation of Liability
IN NO EVENT SHALL PDMGOLF, OUR AFFILIATES, OUR SUBSIDIARIES BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES, THAT RESULT FROM THE USE OF, OR INABILITY TO USE, THE WEBSITE, INCLUDING UNAUTHORIZED ACCESS TO OR ALTERATIONS TO YOUR TRANSMISSIONS OF DATA, UNDER NO CIRCUMSTANCES WILL PDMGOLF, OUR AFFILIATES, OUR SUBSIDIARIES BE RESPONSIBLE FOR ANY DAMAGE, LOSS OR INJURY RESULTING FROM HACKING, TAMPERING OR OTHER UNAUTHORIZED ACCESS OR USE OF THE WEBSITE OR YOUR ACCOUNT OR THE INFORMATION CONTAINED THEREIN. THIS LIMITATION OF LIABILITY SECTION APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS.

Indemnity
You agree to defend, indemnify and hold harmless PDMGolf, our affiliates, our subsidiaries, officers and directors, executives, agents, managers, and other affiliated companies, and their employees, contractors, agents, officers and directors from all liabilities, actions, claims and expenses, including legal fees, asserted by any third party, governmental body or governmental agency, arising out of or relating to: (a) this Agreement; (b) your use of the website; (c) your connection to our website; (d) your violation of this Agreement or (e) your violation of any laws to which you are subject.

General Terms
As a legal resident of the United States or District of Columbia, these Terms and the relationship between you and PDMGolf (including any dispute) shall be governed in all respects by the laws of the State of Nevada without regard to or application of its conflict of law provisions or your state of residence. All claims, legal proceeding or litigation arising in connection with the Services will be brought solely in the federal or state courts located in Carson City County, Nevada, and you consent to the jurisdiction of and venue in such courts and waive any objection as to inconvenient forum.
The failure of PDMGolf to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. In the event that any provision of these Terms is held to be invalid or unenforceable, then that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will remain in full force and effect. If any provision of these Terms of Use is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of the Terms of Use remain in full force and effect.

These Terms constitute the entire Agreement between you and PDMGolf and govern your use of the Service, except, and then only to the extent that you have entered into a Separate Agreement. These Terms supersede any prior agreements or earlier versions of these Terms between you and MyFanFaves for the use of the Service. If, through accessing or using the Service, you utilize or obtain any product or service from a third party, you may additionally be subject to such third party’s terms and conditions applicable thereto, and these Terms shall not affect your legal relationship with such third party.

As a PDMGolf Member, you acknowledge and agree that each affiliate or contest sponsor/partner of PDMGolf shall be a third party beneficiary to these Terms and that such other companies shall be entitled to directly enforce, and rely upon, any provision of these Terms which confers a benefit on (or provides rights in favor of) them. Other than this, no other person or company shall be a third party beneficiary to these Terms.

The section headings in these Terms of Use are for convenience only and have no legal or contractual effect.
